1. Who we are

This website is operated by Creek Candle LLC, a limited liability company registered in the State of Washington, United States, at 1204 Cedar Creek Road, Bellingham, WA 98225. "We", "us" and "our" refer to Creek Candle LLC. "You" refers to anyone visiting or buying from this site.

2. Agreement

By using this site or placing an order you agree to these terms. If you do not agree, do not use the site. We may update these terms; the version in force is the one published here when you place your order.

3. Orders and acceptance

An order is an offer to buy. Our order confirmation email acknowledges receipt, not acceptance. A contract is formed when we dispatch the goods. If we cannot fulfil an order — a scent has sold out, the price was listed in error, or we suspect fraud — we will cancel it and refund you in full.

4. Prices and payment

Prices are in US dollars and exclude sales tax, which is added at checkout where we are required to collect it. We may change prices at any time, but not after you have placed an order. Payment is taken at the time of order by our payment processor.

5. Shipping and returns

Delivery estimates are estimates, not guarantees. Our returns and refunds terms are set out on the Shipping & Returns page, which forms part of these terms.

6. Candle safety

Candles involve an open flame. You are responsible for using them safely:

• Never leave a burning candle unattended.
• Keep it away from children, pets, curtains and anything flammable.
• Burn on a heat-resistant surface, away from draughts.
• Trim the wick to about 5 mm before each burn.
• Do not burn for more than four hours at a time, and stop when 10 mm of wax remains.

We are not liable for damage or injury caused by failure to follow these instructions.

7. Product descriptions

Scent descriptions are subjective and provided in good faith. Because every jar is hand-poured, colour and surface finish vary slightly between batches. Such variation is not a defect.

8. Intellectual property

All content on this site — text, photographs, illustrations, the Creek Candle name and logo — belongs to us and may not be reproduced commercially without written permission. You may share links freely and quote short passages with attribution.

9. Acceptable use

You agree not to attempt to breach the security of this site, scrape it at volume, place fraudulent orders, or use it in any way that breaks applicable law.

10. Limitation of liability

To the fullest extent permitted by law, our total liability arising from any order is limited to the amount you paid for that order. We are not liable for indirect or consequential losses, including lost profits or loss of goodwill. Nothing in these terms limits liability that cannot be limited by law, including for death or personal injury caused by our negligence.

11. Governing law

These terms are governed by the laws of the State of Washington, United States. Any dispute will be brought in the state or federal courts located in Whatcom County, Washington. If you are a consumer resident elsewhere, you may also have rights under your local law that these terms do not override.

12. Severability

If any part of these terms is found unenforceable, the rest remains in force.
